Commissioners have shown recent interest in reviving the FTC’s latent authorities to tackle data privacy, including the Magnuson-Moss Warranty Act rule-making authority.¹⁹⁴ Under new leadership, there are indications that the FTC may move to make better use of these authorities,¹⁹⁵ including over privacy harms.
