EPIC Testifies in Support of Washington State Privacy Bill

EPIC Deputy Director Caitriona Fitzgerald testified today in support of Washington HB 1671, the People’s Privacy Act.
The legislation is based on EPIC and Consumer Reports’ model state privacy bill. It includes data minimization provisions that meaningfully limit the collection and use of personal data. The legislation also bans the sale of sensitive data such as precise geolocation data, data about minors, and health data.
The legislation also includes strong enforcement provisions, stating that any violation is an unfair or deceptive act in trade or commerce and an unfair method of competition under the Washington Consumer Protection Act, which includes a private right of action.
Fitzgerald’s testimony in front of the Washington House Committee on Technology, Economic Development & Veterans highlighted the importance of the bill’s data minimization provisions and strong enforcement mechanisms, including a private right of action, and talked about the harms that stem from commercial surveillance.
“Advertisers and data brokers track our every click, and our data is used against us in ways that harm our wallets, opportunities, and rights,” Fitzgerald said. “At a time when policymakers are concerned about cost-of-living issues for their constituents, the impact of mass data collection and abuse on those costs cannot be ignored.”
