2024 Consumer Rights Litigation Conference & Class Action Symposium

John Davisson, EPIC Senior Counsel and Director of Litigation, and Chris Frascella, EPIC Counsel, will be participating in the National Consumer Law Center (NCLC) and the National Association of Consumer Advocates (NACA)’s 2024 Consumer Rights Litigation Conference & Class Action Symposium.
Chris will be speaking on a panel on “Data Brokers and the FCRA in the Algorithmic State.” He will be joined by Sejal Zota (Just Futures Law), Sarah Mancini (NCLC), and James Ristvedt (Consumer Attorneys).
Panel Description: Lexis Nexis and others have claimed that they’re not a CRA in certain contexts. In addition, state public benefits agencies use consumer reports as well as opaque algorithmic systems to drive eligibility decisions and over-income/assets determinations. Many of these systems are developed by data brokers and trained on consumer financial data, yet agencies rely on them without much oversight. The result: widespread system errors and biases are inequitably removing people from benefits rolls. Through a combination of expert panel discussion and interactive issue spotting using real-world case studies, this course will equip attendees with the knowledge they need to identify consumer financial data harms in the algorithmic state and leverage consumer protection laws like FCRA against benefits tech vendors.
John will be in a panel as part of the Class Action Symposium; John will be addressing about best practices for identifying and proposing recipients of cy pres awards. He will be joined by Jen Wagner, Moderator (NCLC), Lindsay Nako (Impact Fund), Roger Mandel (Jeeves Mandell)
Panel Description: the Class Action Symposium will address evolving changes and emerging developments in class action practice, including: noteworthy court of appeals rulings; discovery techniques; evidentiary challenges and opportunities; developments in class administration; mass arbitration and mass torts as alternatives to class actions; and ethical issues of particular importance in complex litigation cases.
