ABA: Advertising AI: Best Practices and Litigation Risk

Alan Butler, EPIC Executive Director and President, will be participating in the American Bar Associations’s 2025 Antitrust Spring Meeting.

Alan will be speaking on the “Advertising AI: Best Practices and Litigation Risk” panel at 9:00am ET on April 2, 2025. He will be joined by Richard H. Cunningham (Kirkland & Ellis, LLP, Session Chair & Moderator), Natalie Hanlon Leh (Chief Deputy Attorney General, Office of the Attorney General for Colorado), Laura M. Kim (Covington & Burlington LLP), and Shaundra Watson (Senior Director, Policy, Business Software Alliance).

Panel Description: AI has many potential advertising uses, including powering consumer guidance, recommendation tools, and creating collateral. This panel will explore the consumer protection issues that may arise when marketing AI offerings and using AI in advertising, including copyright litigation risk, NAD competitor challenges, liability for hallucinations, and performance claims for products leveraging AI.
