Judge in California Age-Appropriate Design Code Case Gets the First Amendment Wrong—Again

Yesterday, a federal judge issued a second preliminary injunction against California’s Age-Appropriate Design Code (“CAADC”). The judge's First Amendment analysis flouted directions from the Ninth Circuit and the Supreme Court to more critically examine Big Tech’s demands for broad relief from regulation. The decision erroneously questions the constitutionality of every law giving kids special protections online—including the long-standing Children’s Online Privacy Protection Act (“COPPA”).

Vermont Senate Passes Age-Appropriate Design Code

Yesterday the Vermont Senate passed Senate Bill 69, the Vermont Age-Appropriate Design Code (Vermont AADC), on a bipartisan 25-5 vote. Last month EPIC testified in support of the bill and submitted additional written testimony.

EPIC Written Testimony to the Vermont Senate Committee on Institutions in support of the Vermont Age-Appropriate Design Code Act

The Vermont AADC protects minors’ privacy, enhances minors’ autonomy, and ensures their online safety by prohibiting abusive data and design practices. It does not ban minors from social media, and it does not block minors from accessing any type of content. The choices made in drafting make it stand on strong constitutional ground.
