Looking back further, the nonprofit Electronic Privacy Information Center (EPIC) made a similar point in its amicus curiae brief in the Remsburg v. Docusearch case: In that instance, the Docusearch co-owners both “implicitly acknowledg[ed] that many of their clients seek information for illegal or harmful purposes,” as EPIC wrote, “yet their only method of verifying [clients’] intentions is simply asking for a verbal assurance of good intentions.”
