Virginia bill banning sale of location data passes Senate

The Virginia Senate passed a bill today that would prohibit the sale of precise geolocation data.
Senator Russet Perry, the sponsor of SB 1023 and a former prosector and CIA Officer, spoke on the Senate floor before the vote to emphasize the importance of the bill. “Fraudsters and other bad actors can use location data, often aggregated by data brokers, to target vulnerable individuals and otherwise use personal information to cause harm,” Sen. Perry said. “I believe this is an important bill that protects people’s privacy, that protects data that doesn’t need to be sold.”
This bill’s ban of the sale of location data is similar to a protection Maryland enacted in the 2024 Maryland Online Data Privacy Act that bans the sale of all sensitive data, including precise geolocation data. EPIC testified in support of MODPA in both the House and Senate and attended the bill signing.
EPIC supports SB 1023 and urges the Virginia House of Delegates to pass this vital piece of legislation this session.
