“The unions’ concerns are ‘very valid’ despite the legal odds they may face to shield the worker data, said Mayu Tobin-Miyaji, a counsel at the Electronic Privacy Information Center. ‘This is a moment where it is worthy to challenge such a sale, because if this goes through, then so many other companies stand to profit from selling their employee data from decades ago where people didn’t even conceptualize what an AI model could do.'”

“Without private right of action, enforcement remains dependent on state AGs’ political will and their ‘constrained’ resources, Tobin-Miyaji said. AGs ‘can’t always investigate every potential lead and might prioritize certain cases,’ she said.”
