WIN: Trial Court Denies Alaska’s Bid to Dismiss Case Challenging Its Illegal Disclosure of State Voter Roll to DOJ

October 16, 2026

Today, the Alaska Superior Court denied the State of Alaska’s motion to dismiss in League of Women Voters of Alaska v. Dahlstrom, an important case seeking to vindicate Alaskans’ voting and privacy rights after the State unlawfully disclosed its voter roll to the U.S. Department of Justice (DOJ), including confidential personal information and agreed to remove voters at DOJ’s request.

League of Women Voters of Alaska, Alaska Black Caucus, and the Alaska Public Interest Research Group filed suit against Alaska officials in April 2026 after officials unlawfully disclosed the state’s complete and unredacted voter file to DOJ and agreed to “clean” the list by removing voters at DOJ’s request. The plaintiffs, represented by EPIC, the ACLU of Alaska, and the national ACLU Voting Rights Project, argue that Alaska’s actions violate both Alaska law’s requirements for voter list maintenance and Alaskans’ constitutional rights to privacy, to vote, and to due process before their voter registrations are terminated.

The State of Alaska filed to dismiss the lawsuit, arguing that the Plaintiffs did not have standing to sue and that the court could not consider the claims because Alaska had not yet canceled any voter’s registration. The Court disagreed. First, the court found that each organization had standing because privacy is highly relevant to the plaintiffs’ missions to defend Alaskans’ constitutional rights, uphold the right to vote, and promote good governance. The court also noted that there was a high risk that Alaska would act to unlawfully purge voters from its voter rolls. The case continues into discovery and fact-finding.

This is a big win. The Court’s decision affirms that voter privacy is a vital part of protecting the right to vote and encouraging Alaskans to exercise that right. EPIC is proud to represent the plaintiffs in this case as part of its long history defending voter privacy.
