(New Mexico) Letter on H.B. 60

RE: H.B. 60, the New Mexico Artificial Intelligence Act – Support  

Dear Honorable Representatives of the House Judiciary Committee, 

The Electronic Privacy Information Center writes today in support of H.B. 60. This legislation is urgently needed to protect New Mexicans from harms that are already happening every day because of the unregulated use of high-risk AI systems in life-altering decisions. Passing this bill is essential to ensure that AI systems used in making key decisions about the lives of New Mexico consumers and workers are transparent, nondiscriminatory, and accurate – and that individuals have the information and ability to hold companies accountable if AI tools they use do cause harm.  

Companies use high-risk AI systems in making decisions about people’s housing, employment, education, health care, and finances every day, and these tools affect the lives of nearly every American. AI systems have led to the wrongful denial of people’s access to housing, medically necessary coverage, job opportunities, loans, and more.  

H.B. 60 contains clear definitions, meaningful consumer rights to explanation and appeal, important transparency and disclosure requirements, and strong enforcement mechanisms. Importantly, this bill avoids including many of the loopholes present in other states’ similar bills that, in effect, often render a bill meaningless. While EPIC would prefer to see H.B. 60 prohibit algorithmic discrimination outright rather than implementing a duty of care standard, this bill is still a significant step forward. Passing this bill would provide real protections and rights for New Mexicans and ensure companies developing and using AI do so safely and responsibly.
