EPIC, STOP, and Free Press Rebuff FCC Inquiry on Preempting State AI Regulations

On December 18, EPIC, the Surveillance Technology Oversight Project (STOP) and Free Press filed Reply Comments with the FCC rejecting the agency’s proposal to preempt state AI regulations in its Notice of Inquiry (NOI) in the “Build America: Eliminating Barriers to Wireline Deployments” proceeding.
EPIC et al argued that Congress did not grant the FCC jurisdiction to preempt state AI regulations and that preemption of state AI guardrails would be ill-advised and unpopular, as evidenced by the vibrant policy activity at the state level and persistent opposition to Congressional attempts to preempt states on AI issues.
On January 15, EPIC filed similar Reply Comments on its own, rejecting the FCC’s proposal to preempt state AI regulations in its Notice of Proposed Rulemaking (NPRM) in the “Build America: Eliminating Barriers to Wireless Deployments” proceeding.
EPIC supports sensible safeguards to protect people from AI-generated harms, releasing guidance to this effect and opposing attempts to preempt state-level solutions.
