EPIC Testifies in Support of New York AI Act

January 16, 2026

EPIC Counsel Kara Williams testified in support of the New York AI Act (S1169A), a bill prohibiting algorithmic discrimination.

The bill, sponsored by the Chair of the Standing Committee on Internet and Technology Sen. Kristen Gonzalez, places important testing and transparency requirements on companies that develop or use AI systems in certain critical contexts like housing, employment, and health care.

Under this bill, companies that use AI systems in making decisions about people’s lives would have to inform people before using AI and give them the right to opt out or to appeal the decision. The bill would also require companies that develop or use AI systems to regularly conduct independent audits and submit reports to regulators.

Importantly, the bill contains a private right of action that would allow New Yorkers to enforce their rights by bringing legal action against companies that violate this Act.

EPIC has worked with state legislators across the country on similar AI bills and has long focused on centering people in AI policy.
